Criptoactivos : entre la identificación de riesgos y la incertidumbre legislativa

Abstract

RESUMEN: El presente artículo recopila y describe los riesgos que presenta el uso de los Criptoactivos, para evidenciar cómo se vinculan con los prototipos normativos que se han propuesto desde diferentes autoridades y finalizar con la exposición del estado normativo de los Criptoactivos en Colombia. Por lo tanto, el texto se divide en cuatro partes: en la primera se define, en términos generales, la naturaleza de los Criptoactivos para relacionarlos con el Blockchain como tecnología subyacente; en la segunda se caracterizan los riesgos generados por el uso de los Criptoactivos, los cuales se identificaron mediante el proceso investigativo que soporta este artículo; en la tercera se hace un esbozo del tratamiento regulatorio extranjero y nacional para mitigar dichos riesgos; en la última se presentan las conclusiones.

ABSTRACT: Considering the proliferation of Cryptoassets in Colombia, this research article compiles and describes the risks presented by the use of these at global level, showing how they are linked to the regulatory prototypes that have been proposed by different regulatory authorities, ending with the exposition of the legislative status of Cryptoassets in Colombia. Therefore, the text is divided into four parts: the first defines, in general terms, the nature of Cryptoactives to relate them to Blockchain as an underlying technology; in the second, the risks generated by the use of Cryptoactives are characterized, which were identified through the investigative process that supports this article; the third outlines the foreign and national regulatory treatment to mitigate said risks; in the last one the conclusions are presented.
