Los falsos dilemas del neoconstitucionalismo relación entre derecho y moral : unión necesaria vs separación radical

Abstract

RESUMEN: Este trabajo presenta la relación actual entre derecho y moral, bajo el prisma de las corrientes teóricas del neoconstitucionalismo y el positivismo, a partir del cual se presenta dos posiciones antagónicas: una conexión necesaria vs una separación radical. No obstante, ante el dilema de esta relación se presenta una posición intermedia, denominada positivismo incluyente, postpositivismo o constitucionalismo positivista, que se concreta en los ámbitos de creación, existencia, validez, interpretación y justificación del derecho.

ABSTRACT: This paper presents the actual relationship between right and morality, under the theoretical currents of neoconstitutionalism and positivism, from which two opposing positions are presented: a necessary connection vs a radical separation. However, between this relationship it is presented an intermediate position, called inclusive positivism, post-positivism or positivist constitutionalism; as embodied in the areas of creation, existence, validity, interpretation and justification of the right.
