Ley, Transgresión y Subjetividad

Abstract

RESUMEN: Frente a la tarea de desplegar una teoría de la sociedad, diversas lecturas inscritas en el marco de las ciencias sociales se han visto conminadas a precisar los conceptos de ley y transgresión, sin llegar, empero, a otorgar un valor preponderante al lugar de la subjetividad. La presente investigación gravita en torno a la pregunta por cómo se constituye la ley, en su relación con la transgresión, y por la manera en que allí se pone en juego la problemática de la subjetividad. Así, a partir del método documental argumentativo, se toma como referencia el edificio teórico del psicoanálisis, y su entrecruzamiento con diversos terrenos del saber, para realizar una interlocución entre la epistemología aportada por Freud, y luego por Lacan, a propósito del interrogante por el origen de la ley, en su relación con el lenguaje, la moral, la naturaleza y la cultura. ¿Qué es primero, la ley o la transgresión?, ¿cuál la naturaleza de tales conceptos?, ¿se supeditan a la acción humana, o de qué vienen a ser efecto? He aquí algunos de los interrogantes que orientan la reflexión y habilitan una discusión en torno al evolucionismo y el creacionismo en tanto tentativas de respuesta.

ABSTRACT: Faced with the task of developing a theory of society, various readings within the framework of social sciences have been forced to clarify the concepts of law and transgression, without, however, giving a preponderance value to the place of subjectivity. The present investigation revolves around the question of how law is constituted, in its relationship with transgression, and the way in which the problematic of subjectivity is put at stake. Thus, using the argumentative documentary method, the theoretical framework of psychoanalysis and its intersection with various fields of knowledge are taken as a reference to establish a dialogue between the epistemology provided by Freud and then by Lacan regarding the question of the origin of law in its relationship with language, morality, nature, and culture. What comes first, law or transgression? What is the nature of these concepts? Are they subordinated to human action or what is the reason behind them? These are some of the questions that guide reflection and enable a discussion around evolutionism and creationism as attempts to answer them.
