La adopción de niños indígenas en Colombia

Abstract

RESUMEN: Este artículo busca reflexionar acerca del proceso de adopción de niños indígenas, en concordancia con los principios constitucionales del interés superior del niño y la autodeterminación de las comunidades indígenas, usando una metodología de investigación cualitativa, luego de realizar una búsqueda en varios repositorios de universidades como la Universidad de Antioquia, EAFIT, Universidad Nacional de Colombia, entre otras, además en las bases de datos Redalyc, Scielo y Dialnet se encontró que son muy pocas las investigaciones en torno a este proceso, por lo tanto se utilizaron en mayor medida las producciones científicas que giran en torno del interés superior del niño y de la autodeterminación de las comunidades indígenas, principios indispensables para tatar este tema. Estas reflexiones concluirán en que, si bien el interés superior del niño indígena trae inmerso en su materialización la autodeterminación de las comunidades indígenas, si en el caso concreto de adopción se evidencia que ambos principios chocan, en la decisión final debe prevalecer el interés superior del niño.

ABSTRACT: This article seeks to reflect on the process of adopting indigenous children, by the constitutional principles of the best interests of the child and the self-determination of indigenous communities, using a qualitative research methodology, after searching in several university repositories such as the University of Antioquia, EAFIT, National University of Colombia, among others, in the databases Redalyc, Scielo and Dialnet found that there are very few investigations around this process, therefore they were used to a greater extent scientific productions that revolve around the best interests of the child and the self-determination of the indigenous communities, essential principles for dealing with this topic. These reflections will conclude that, while the best interests of the indigenous child involve the self-determination of indigenous communities in their realization, if in the specific case of adoption it is evident that both principles clash, the best interests of the child must prevail in the final decision.
