Análisis comparativo del feminicidio en América Latina

Abstract

RESUMEN: Este artículo busca analizar de manera comparada, cómo se ha producido la regulación en torno al feminicidio y cómo este tipo penal, se ha convertido en una de las principales herramientas implementadas a nivel internacional como muestra de un compromiso gubernamental para la erradicación de toda forma de violencia contra la mujer. Dicho análisis se plantea desde la metodología de reflexión ante la disparidad de realidades que viven hombres y mujeres desde principios de la historia hasta la actualidad y cómo estas se han materializado en comportamientos violatorios de derechos fundamentales, siendo necesario visibilizar estas problemáticas que requieren ser erradicadas, no solo para dar cumplimiento a instrumentos internacionales, sino por la necesidad de procurar una vida garante de derechos fundamentales a todos los seres humanos, en especial a la población femenina. Este estudio se llevó a cabo mediante la revisión de legislación, jurisprudencia y artículos de los países objeto de interés, en donde se observa cómo de manera histórica el feminicidio y la violencia feminicida ha sido entendida como asuntos de índole privado, que han sido naturalizados por los gobiernos patriarcales de América Latina, siendo ahora fundamental la deconstrucción del discurso y la concientización de la subordinación del género femenino.

ABSTRACT: This article seeks comparative analysis of how the regulation of femicide has occurred and how this type of criminal offense has become one of the main tools implemented internationally as a sign of a government commitment to the eradication of all forms of violence. against women. Said analysis arises from the methodology of reflection before the disparity of realities that men and women live from the beginning of history to the present day and how these have materialized in behaviors that violate fundamental rights, making it necessary to make visible these problems that must be eradicated , not only to comply with international instruments, but due to the need to ensure a life that guarantees fundamental rights to all human beings, and especially to the female population. This study was carried out by reviewing legislation, jurisprudence and articles from the countries of interest, where it is observed how feminicide and feminist violence have been historically understood as private matters, which have been naturalized by the patriarchal governments of Latin America, being now fundamental the deconstruction of the discourse and the awareness of the subordination of the feminine gender.
