Perfil del mediador penal en Colombia en el marco de la justicia restaurativa de la Ley 906 de 2004

Abstract

RESUMEN: La mediación penal como mecanismo de justicia restaurativa, tiene como objetivo buscar la solución pacífica de un conflicto que es materia de controversia en un proceso penal entre la víctima y procesado, la cual requiere de la ayuda de un tercero neutral denominado mediador, quien tiene el gran reto de colaborar en este proceso para evitar que el conflicto siga su curso en los despachos judiciales y en este sentido, se pueda llegar a un acuerdo entre las partes, el cual debe tener como referente las necesidades de las víctimas, la responsabilización del ofensor y así mismo, debe propender por la reconstrucción del tejido social. Así las cosas, el mediador en estos procesos penales juega un rol protagónico, por lo tanto, se requiere que este profesional tenga un perfil con una serie de características personales (psicológicas) y una formación profesional (jurídico – penal) que le permitan desarrollar de manera adecuada su función. Por lo anterior, en este artículo se evidenciarán los aspectos personales y profesionales que conforman el perfil que debe tener el mediador penal en Colombia.
