Capacitación judicial: todo para construir

Abstract

RESUMEN: Se plantean dos falencias que el autor observa en un plan de capacitación presentado por la Sala Administrativa del Consejo Superior de la Judicatura de Colombia en el Segundo Encuentro de esta institución, celebrado en Medellín el 21 y el 24 de noviembre de 2001, basado en la necesidad de atender especialmente dos aspectos, a saber: en primer lugar, la formación política del juez como herramienta necesaria para entender el carácter de Poder Público de la Judicatura, lo mismo que las nuevas tareas que el modelo de Estado (Social de Derecho) que ha sido adoptado por la Constitución Política colombiana en su artículo 1. ºle asinga en su tarea de administrador dejusticia, lo mismo que la necesidad de conocer y entender la sociedad en la que se desenvuelve como requisito fundamental para darle mayor importancia y pertinencia a la noble labor que cumple y finalmente como elemento fundamental de la consolidación de la independencia judicial, afectada de diferentes maneras, desde dentro y desde fuera del Estado. En segundo lugar, se llama la atención sobre la necesidad de contar con la academia colombiana para mejorar la formaciòn judicial, no solamente en los aspectos dogmátocps sino políticos, de tal forma que se supere cierta "endogamia" presente cuando son los mismo funcionarios judiciales quienes realizan la capacitación de otros miebros de la rama judicial.

ABSTRACT: Two failures are stated by the author on the training plan presented by the Administrative Court of the Upper Council of the Judiciary of Colombia at the second meeting of that institution, held in Medellin November 21st to 24th of2001, based in the need of attending specially two aspects, namely: In first place, the judge's political education as a necessary tool to understand the nature of the Public Power of Judiciary, as well as the new chores that the model of state (Social of Law) that had been adopted by the Political Constitution of colombia in its 1st article assigns in its task of administrator of justice, as well as the need of knowing and understanding the society in whichit develops as a fundamental requirement to give more importance and pertinence to the noble task that it carries out and finally as a fundamental element of the consolidation of the judicial independence, affected in different ways, from inside and outside of the state. In the second place, attention is called over the necessity of counting on the Colombian academy to improve the judicial training, not only on the dogmatic but also in the political aspects, in a way that overcome certain "endogamy" present when is the judicial functionaries themselves who carry out the training for other members of the judiciary.
