Los derechos de las víctimas de la violencia política a la verdad, la reparación y la justicia : reflexiones sobre cuatro casos en América Latina

Abstract

RESUMEN: A partir de los antecedentes teóricos de la justicia transicional y elexamen de algunos casos en los que ésta se aplicó en América Latina, el autor pone entensión la necesidad de paz y por ende de olvido de los gobiernos en medio deconflictos armados y las exigencias de justicia y resarcimiento de las víctimas; estocon el fin de justificar su posición con relación al objetivo que debe buscar la justiciatransicional, a saber, que éste debe estar restringido exclusivamente a la rehabilitaciónde las víctimas políticas y no tiene que ver ni con la reestructuración total de lasociedad ni con el trato de las grandes injusticias sociales del pasado.Palabras claves:Justicia transicional; Ley de Justicia y Paz; Víctimas; Conflictoarmado en América Latina; Derechos Humanos.

ABSTRACT: Starting with the theoretical antecedents of transitional justice and theexamination of some cases in Latin America in which they were applied, the authorquestions the need for peace and therefore for oversight of governments in the middle ofarmed conflicts, and the demands of justice and payment to victims; this in order tojustify his position with relation to the objective of transitional justice which he believesshould be restricted exclusively to the rehabilitation of political victims and it shouldnot deal with either the total restructuring of society or the treatment of large socialinjustices of the past.
