La infancia en tensión : de un sujeto en disputa con él y con los otros

Abstract

RESUMEN:La presente monografía pretende, inicialmente, rastrear la diversidad de nociones de la infancia que se han instalado en los múltiples contextos histórico-políticos y culturales de Occidente, dejado una impronta no solo en el imaginario colectivo, sino en la consolidación de los Estados modernos, con sus respectivas instituciones familiares, educativas y científicas o disciplinares. Por esa vía también busca comprender cuáles han sido los sentidos que se le han otorgado al significante infancia, y a partir de allí indagar, rastrear, extraer la noción de infancia que subyace a la Ley 1098 de 2006 por la cual se expide el Código de la Infancia y Adolescencia, con ayuda de las nociones y conceptos que sobre la infancia y el niño plantea Sigmund Freud en su texto “Tres ensayos de teoría sexual”, escrito en 1905, y la forma como en ambas nociones emergen contrastes y tensiones frente a las categorías de familia, Estado y sexualidad. Finalmente, vale la pena precisar que el presente trabajo de monografía, como ejercicio escritural crítico sobre un tema particular con base en una revisión bibliográfica completa, también supone la relevancia de la experiencia de quien escribe, y de esa manera contrarrestra las fuentes bibliográficas con las percepciones personales de la autora, quien desde el inicio trae consigo el asomo de una duda o sospecha frente a los vacíos que se dejan entrever entre el discurso jurídico sobre el niño, como sujeto de derechos, y el niño como sujeto pulsional, que debe comprenderse en relación con su sexualidad, su pulsión, y con los otros, enmarcado en contextos dinámicos de conflicto, carencias y desigualdad.

ABSTRACT: This monograph initially aims to trace the diversity of notions, perceptions and/or representations of childhood, which have been established in multiple historical, political and cultural contexts of the West. These representations, have left an imprint not only on the imaginary collective, but also in the consolidation of modern states, with their respective family, educational, scientific and disciplinary institutions. By reviewing these notions it is sought to understand what are the insights that have been given to the signifier of childhood and from there to inquire, trace, extract the notion of childhood that underlies the 1098 Law of 2006: the "Code of Childhood and Adolescence", with the help of the notions and concepts that Sigmund Freud addresses about childhood and child in his text “Three essays on sexual theory”, written in 1905 and the way in which both notions emerge, with contrast and tension against the categories of family, sexuality and State. The present monographic work, which as a written exercise, aims to be a critical approach to a particular subject, based on an exhaustive documentary and bibliographic review. It also seeks to collect the experience or knowledge of the writer, counteracting it with bibliographical sources and confronting it with personal perceptions of the author who, from the beginning of this writing exercise, brings with it the shadow of a doubt or suspicion of the gaps that can be found between the legal discourse and its understanding of the child, and therefore of the institutions (family, school, science), the State and the reality of the child as a subject to be understood in relation to his “Trieb” condition with others, framed in his/her dynamic contexts of conflict, deprivation and inequality.
