De la naturaleza jurídica del derecho a la salud en Colombia

Abstract

RESUMEN: El derecho a la salud se constitucionalizó de forma expresa enlos artìculos 44 y 49 de nuestra actual Constitución Política como un derecho inherente a la persona. Según un primigenio criterio formalista de interpretación el derecho a la salud fue considerado como un derecho meramente prestacional debido a su ubicación topográfica en dicha Constitución. De allí, y por influjo directo de las consideraciones jurisprudenciales de la Corte Constitucional, parece haberse reconocido como un derecho fundamental per se. El derecho a la salud analizado en clave del Estado social es un verdadero derecho fundamental, por ello, debe ser protegido por todas las garantías constitucionales y legales propias de tal tipo de derechos.

ABSTRACT: The rigth to health was established in the articles 44 and 49 of our Politic Constitution howa inherent right to the person. According to a formalism view of the right, the right to health was consider how a right merely benefit, due to the ubication in the Constitution. However, the jurisprudence of Constitutional Court about the topic, has said that the right to health is a fundamental right per se. The right to health interpreted through Social State of Law, is a fundamental right, then, it should be protected with all constitutinals guarantee.
