Organismos reguladores del sistema de salud colombiano: conformación, funcionamiento y responsabilidades

Abstract

RESUMEN: La regulación es una manera de intervención del sector público, el cual utiliza su poder legítimo y coactivo para establecer restricciones a las actividades de los agentes que participan en el mercado y, de este modo, garantizar la asignación eficiente de bienes y servicios y el bienestar social. En Colombia, como experiencia interesante a nivel internacional, se adoptó para el sector salud un esquema de competencia regulada en el que participan tres organismos con funciones de regulación, uno de carácter colegiado y otros dos que son dependencias centrales del ejecutivo. Al analizar en este caso quién, qué y cómo se regula, se encuentran aspectos críticos enmarcados en la falta de planeación estratégica de largo plazo y algunos elementos inherentes a la estructura del organismo colegiado, lo que pone en duda su autonomía y la búsqueda del bien común en la toma de decisiones. En este contexto, se plantean interrogantes sobre la manera como los agentes que participan en la regulación pueden encaminar las medidas tomadas, así como asuntos sobre la representatividad del cuerpo colegiado y los mecanismos de elección de sus representantes.

ABSTARCT: Regulation is a way of intervention of the public sector, which uses its legitimate and coercive power to establish restrictions to agent’s activities who participate in the market and guarantee the efficient allocation of goods and services and social welfare. In Colombia, as an interesting international experience, the health care sector adopted a scheme of regulated competition in which three organisms with regulation functions participate; one of those is a committee of public choice and the other two are executive central branches. In this case, analyzing who, what and how is regulated, we find critical aspects trapped in the lack of long term strategic planning and some inherent elements to the committee structure which puts in doubt its autonomy and the search for social welfare in decision making. In this context, questions about how is the agent’s participation in the regulation can direct the taken measures, as well as issues that consider representativeness of the committee and the election mechanisms of their representatives
