Dialéctica del castigo : institución, moralidad y control en las sociedades modernas

Abstract

RESUMEN: Este artículo se ocupa del tratamiento de la criminalidad y algunas de sus consecuencias para la noción de castigo en las sociedades neoliberales y de control de la modernidad tardía, ampliando la idea legalista de estigmatización culpable, toda vez que esta se inserta en la racionalidad gubernamental y la conducción que opera sobre los ciudadanos a través del convencimiento de estos en el entramado securitario actual, que recoge y transforma tanto el modelo de la soberanía y el modelo jurídico como el de la disciplina. Se mostrará entonces cómo la culpabilidad jurídica se modula con diversos factores de la modernidad y su lógica para castigar, combinándose tanto de forma aleatoria y material —praxis punitiva y azar del acontecimiento— como racional, según el afán de control y seguridad propios de las políticas punitivas actuales. Para esto se empleará una metodología principalmente genealógica toda vez que se trata no solo de interpretar algunos textos clave de la teoría jurídico-criminológica, sino presentar varias influencias y tensiones de la racionalidad económica y material que han impregnado el devenir punitivo en dichas sociedades.

ABSTRACT: This paper will approach the issue of the treatment of criminality and some of its consequences for the notion of punishment in neoliberal and controlling societies in late modernity. It expands the legalist idea of guilt stigmatization whenever it inserts itself into the paradigm of governmental rationality and control that operates on citizens through their own convictions and internalization of the laws —subjection and subjectivation— in the current security structure that gathers and transforms the legal, sovereignty, and discipline models. This study will show how legal guilt is modulated by various factors of modernity and its punishment logic, whose elements combine themselves materially, randomly (i.e. the punitive praxis and the randomness of an event), and rationally in accordance with the search for control and security characterizing the punitive policies of modernity. To this end, a mainly genealogical methodology shall be used, since the goal is not only to interpret some key texts of legal and criminological theory but also to point to several influences and tensions of economic and material rationality that have permeated the punitive process in the studied societies
