La acción de tutela como mecanismo de protección de los derechos laborales

Abstract

RESUMEN: El presente trabajo tiene como finalidad analizar si la acción de tutela permite a cualquier ciudadano que esté vinculado a cualquier empresa o entidad, ya sea pública o privada, a que se le garanticen los derechos laborales que crea que han sido violados o vulnerados por cualquier agente, sea el empleador, la EPS, ARL, entre otros. Todo esto, verificando que se cumpla el debido proceso, y realizando también un análisis a los derechos fundamentales con el fin de llegar a una tutela judicial efectiva. Dando como conclusión, que la acción de tutela se estableció como una herramienta para la solicitud ante cualquier entidad la protección de los derechos vulnerados, existe una parte restrictiva y excluyente de la tutela como mecanismo de defensa de algunos derechos especificados en la constitución nacional, como es la vulneración a los derechos laborales.

ABSTRACT: The purpose of this work is to analyze whether the protection action allows any citizen who is linked to any company or entity, whether public or private, to be guaranteed the labor rights that he believes have been violated or violated by any agent, be it the employer, the EPS, ARL, among others. All this, verifying that due process is complied with, and also carrying out an analysis of fundamental rights in order to achieve effective judicial protection. In conclusion, that the tutela action was established as a tool for requesting before any entity the protection of violated rights, there is a restrictive and exclusive part of the tutela as a defense mechanism of some rights specified in the national constitution, such as It is the violation of labor rights.
