La ley tiene una santidad especial : etnografía del estado a través de la Ley 1448 de 2011

Abstract

RESUMEN: El presente trabajo analiza cómo la figura del Estado es construida y ejerce su legitimidad a través de las imágenes y prácticas de estatalidad que se dan en torno a la creación e implementación de la Ley 1448 de 2011. Para lograr este objetivo se recurrió a la etnografía como estrategia metodológica para identificar y analizar las prácticas e imágenes del Estado en relación a la ley a través de dos elementos centrales. El primero, los documentos legales que anteceden la creación de la Ley 1448. Y, segundo, las interacciones entre personas que acuden a la ley para su reconocimiento oficial y/o para las medidas reparación, y los funcionarios. A lo largo del texto se reflexiona sobre las formas e implicaciones simbólicas y materiales que tiene el Estado y la Ley 1448 en la vida cotidiana de las personas nominadas víctimas oficiales, victimas rechazadas/no incluidas y en quienes representan el rostro oficial del Estado. A través de un énfasis simultaneo en la teoría y la etnografía se reconoció al Estado más allá de la ficción abstracta que lo ubica por encima y por fuera de las personas para comprender en las relaciones entre sujetos que se dan a causa de la Ley 1448, los marcos de reconocimiento que produce el Estado, sus limitaciones y posibilidades, y los aportes que esto tiene para el campo de la antropología política y la antropología del Estado.

ABSTRACT: This work analyzes how the figure of the State is constructed and exercises its legitimacy through the images and practices of the state that are given around the creation and implementation of Law 1448 of 2011. To attain this objective, ethnography was used as a methodological strategy to identify and analyze the practices and images of the State in relation to the law through two central elements. The first, the legal documents that precede the creation of Law 1448. And, second, the interactions between people who come to the law for their official recognition and / or for reparation measures, and state officials. Throughout the text, I reflect on the symbolic and material forms and implications that the State and Law 1448 have in the daily life of people named as official victims, rejected victim or not included, and who represent the official face of the State. Through a simultaneous emphasis on theory and ethnography, the State was recognized beyond the abstract fiction that places it above and outside of people to understand the relationships between subjects that occur because of Law 1448: the frameworks of recognition produced by the State, its limitations and possibilities, and the contributions that this has for the field of political anthropology and the anthropology of the State.
