Propuesta de una figura de protección para los predios en comodato al Consejo Comunitario Afrodescendiente de San Andrés, en Girardota

Abstract

RESUMEN : En el presente estudio tiene como objetivo proponer una figura de protección para los predios que posee en comodato el Consejo Comunitario Afrodescendiente de San Andrés, en el municipio de Girardota-Antioquia, teniendo como base las pretensiones de las integrantes del Consejo. Esto se desarrolló por medio de revisión de normativa (leyes, decretos, resoluciones y acuerdos) relacionados con áreas protegidas ya declaradas de Reserva Natural de la Sociedad Civil -RNSC-, Parque Natural Regional -PNR-, Distrito Regional de Manejo Integrado -DRMI- , Distrito de Conservación de Suelos -DCS- y Reserva Forestal Protectora Regional -RFPR- y demás material normativo relacionado con la declaratoria de áreas protegidas; entrevistas con personas con bagaje en las áreas de: trabajo social, áreas protegidas, faunístico, forestal y la compra de predios por la cual el Consejo hoy posee el comodato; además se desarrollaron encuentros con la comunidad, levantamiento de información en campo y revisión cartográfica. Los resultados mostraron que las categorías elegidas del Sistema Nacional de Áreas Protegidas -SINAP- en este estudio pueden no aplicarse o supondrían el cambio del contrato de comodato, en otras palabras, el Consejo Comunitario ya no administraría dichos predios según lo establecido en el Decreto 1076 de 2015 para cada definición de cada categoría propuesta. Este hallazgo no implica necesariamente que el Consejo no pueda establecer el predio La Linda, en comodato, como área protegida ya que pueden optar por fortalecer el contrato del que gozan estableciendo acciones con la autoridad que el mismo les brinda y apuntar a que les sean cedidos esos predios.

ABSTRACT : The objective of thisstudy isto propose a figure of protection for the properties owned by the Afrodescendant Community Council of San Andrés, in Girardota, based on the claims of the members of the Council. This was developed through the review of decrees related to protected areas already declared as Civil Society Natural Reserve -RNSC-, Regional Natural Park -PNR-, Regional Integrated Management District -DRMI-, Soil Conservation District -DCS- and Regional Protective Forest Reserve -RFPR- (acronym in Spanish) and other regulatory material related to the declaration of protected areas; interviews with people with backgrounds in the areas of: social work, protected areas, wildlife, forestry and the purchase of land for which the Council currently holds the loan; In addition, meetings were held with the community, information gathering in the field and cartographic review. The results showed that the categories chosen from the National System of Protected Areas -SINAP- in this study may not apply or imply the change of the bailment contract, in other words, the Community Council would no longer manage said properties as established in Decree 1076 2015. This finding does not necessarily imply that the Council cannot establish the La Linda property on loan as a protected area since they can choose to strengthen the contract they enjoy by establishing actions with the authority that it provides them and aim to those properties are transferred.
